<p>September 13, 2005</p>
<p>The Hartz Mountain Corporation<br />
400 Plaza Drive<br />
Secaucus, New Jersey 07094<br />
Attention: 	Consumer Relations Department</p>
<p>Re:	Adverse Effect Report and Damages Claim &#8211; EPA Reg. No. 2596-148 (Hartz Advanced Care Flea &#038; Tick Drops Plus + For Cats and Kittens Weighing 10 Pounds or Less) (the “Product”) </p>
<p>
Ladies and Gentlemen:</p>
<p>This letter shall put The Hartz Mountain Corporation (“Hartz” or “you”) on notice that the above-referenced Product, which we used in strict accordance with the package instructions, poisoned our two cats, seriously upset the members of our household and caused us to incur a veterinary bill in the amount of $780.00.  The amount of this veterinary bill, together with the cost of the Product including tax ($8.83) equals $788.63 (collectively, the “Costs”).  Without prejudice to any other right we may have, we hereby demand an apology from Hartz and full (and unconditional) compensation for the Costs we incurred, immediately, and in any event no later than October 14, 2005.  This 30-day response period is customary, reasonable and fair, particularly because Hartz has been on notice for at least 3 years of the dangers of this Product.  Our further explanation and documentation supporting of our claim are set out below. </p>
<p>We purchased the Product on August 16, 2005 at the Rite Aid Pharmacy (Store #06288) located at 959 Crenshaw Boulevard, Los Angeles California.  The original receipt for this transaction in the amount of $8.83 is attached hereto as Attachment A.  The package advertises the Product as for use on cats and kittens weighing 10 pounds or less, providing further that the Product is not for use with kittens under 12 weeks old, old cats or cats with certain conditions (such as pregnancy or known sensitivities).  The original Product packaging is attached hereto as Attachment B.  Our two cats were healthy and 15 months old.  One weighed 10 + pounds, the other weighed 9 + pounds.  In reliance on these Product package instructions we purchased the Product.</p>
<p>We applied the Product to our cats the same day, following the instructions strictly.  Although the instructions did not instruct us to keep the cats apart, one was let outside and the other kept in the house for several hours until we went to bed that night.</p>
<p>The next morning, our cats were twitching and jerking violently.  Their eyes rolled back, they panted and appeared grotesque and in pain.  It was very upsetting to watch.  I took the cats, together with the Product packaging, to<br />
<i> Dr. Name Withheld</i> of the <i>Name Withheld</i> Animal Hospital.  The cats’ condition worsened in the car and at the vet’s office.<br />
<i>  Dr. Name Withheld</i> admitted the cats, determined that they had been poisoned by the Product and treated them for poisoning by the Product.  He held them 24 hours.  An original of<br />
<i> Dr. Name Withheld&#8217;s</i> statement, which attests to their condition and describes the course treatment delivered, is attached hereto as Attachment C.  I picked the cats up and paid<br />
<i> Dr. Name Withheld&#8217;s</i> bill for $780.00 on August 18, 2005.  Originals of <i> Dr.<br />
Name Withheld&#8217;s</i> itemized bill and my credit card receipt for these amounts are attached hereto as Attachment D. </p>
<p>While the cats were hospitalized, I contacted the Hartz customer service number on the Product package and Hartz website to ask for specific treatment information that I might transmit to my vet.  Maddeningly, the customer service representative was rude, defensive and uncooperative.  He refused to communicate any treatment information because I was not calling as a veterinarian.  I called back and was this time told the on-duty vet was busy, and was instead put through to a private consultant identified as Prosar Animal Poison Control (assigned case no. 1-130-57-639).  After a total of 30 minutes of phone trees, hold time and rudeness from Hartz, the consultant was at last responsive. </p>
<p>Most egregious of all, it turns out that our experience with the Product is common.  Numerous pet-owners have posted their stories on<br />
www.HartzVictims.org.  In addition, the US EPA took its first action against the Product, to strengthen the Product label, back in 2002.  Later, as pet poisonings continued without abatement, the EPA required the Product to be discontinued.  Only under the pressure of an administrative action by the EPA did Hartz belatedly agree to withdraw the Product but not without a final delay of many months.  We are appalled that Hartz launched this obviously defective and dangerous Product, a state of affairs compounded by Hartz’s insistence on selling this poison through the end of the year.  You clearly knew and should have known that the Product was unsafe when you launched it, and you had and have an obligation to pull it from store shelves immediately upon being notified by the public of the Product’s ill effects.  How unethical that Hartz should negotiate a tail of so many months to sell off its stocks rather than recall the Product directly.  If Hartz had recalled the Product instead of negotiating this tail period, our cats would never have been poisoned.</p>
<p>Finally, in connection with this claim, we are also urging your retailers to cease carrying the Product immediately, both as an ethical matter and to mitigate further liability.</p>
<p>Nothing in this letter shall limit any right or remedy we may have against any party, and we fully reserve our right to seek, without limitation, the full amount of the Costs, additional damages and equitable relief.</p>

Can I buy this chew toy?  Can I send flea collars to my son who is in the Army in the Middle East to prevent desert ticks?  Can I give my canary Hartz food?  Can I use Hartz flea powder around my apartment even if I don&#8217;t have pets?&#8221;</p>
<p>
NO!  Absolutely not.  Even if you don&#8217;t have a pet, call a vet for his or her recommendation.  I get pretty damn upset when people e-mail me and tell <i>me</i> to go to hell because <i>I</i> killed their cat because they think <i>I&#8217;m</i> Hartz.  But what upsets me more is when people ask me if it&#8217;s okay to use a certain kind of Hartz product.</p>
<p>
No!  I&#8217;m not going to advocate the use or purchase of ANY Hartz product.  Basically what you&#8217;re doing is saying, &#8220;Hey, Josh, I&#8217;d like to support the company that almost killed your cat, as well as thousands of others, by asking you if it&#8217;s okay to purchase a product manufactured by Hartz.&#8221;</p>
<p>
I hate to be so forthright and blunt, but, use your damn head.</p>
<p>
No!  Do not buy a damn Hartz product.  Ever.</p>
<p>
If you do, you&#8217;re killing someone else&#8217;s pet.</p>
<p>

AnimalHelp.Com would be interested in running this information in the Consumer reports Section of the site. We will also provide a link back to hartzvictims.com. BUT this article would have to be politically correct in that it should not be a bashing fest, but rather facts and figures, what to watch for, safe alternatives, etc. Our site gets approx 400,000 visitors a month and we CAN help spread the word. I do know hartz products are not safe and would be very interested in featuring this story.

With a $200 vet bill, and hopefully a successful next 14 days, he should be back to normal. After receiving steroid &amp; antibiotic injections, fluids via IV, several antibiotic flushes &amp; oral antibiotics (antibiotics will be given for 14 days, flushes at home 2/day and to get him to eat/drink, special &quot;milk&quot; and food &quot;gravy&quot;.) </p>
<p>I&#8217;ll take him back for checkup in a week. He seems alot better but the pics I am sending were AFTER the vet. He also weighed about 18 lbs. and seemed lighter and more picky about eating&#8230;he is down to 14lbs. The vet said that it was definately caused by the collar. I am surprised TJ didn&#8217;t die and did so well as he&#8217;s no youngster&#8230;about 11 yrs. old.  Given research that I have done, apparently there are thousands and thousands of animals that are being maimed and killed by your products (example- www.<strong>hartzvictims</strong>.org) . I am furious that this product is still available and that I hadn&#8217;t heard anything about it until TJ almost died. Please advise.</p>

To Whom It May Concern:</p>
<p>
On October 6, 2004, I purchased your Hartz 3 and 1 Flea, Tick and Mosquito Drops for cats over 10 pounds, Advanced Care.</p>
<p>
I read all the warnings and how to apply the medicine.  NOTE regarding the WARNINGS:</p>
<p>
I realize in this day, if there have been adverse reactions from a product, via a study or by actual consumers having a problem with a product; any company must put the warning on the label.</p>
<p>
Thus, in reading the Warnings on the label, I thought that the adverse reactions were probably in a relatively few cases.</p>
<p>
Through my experience these past few days, this in not the case.  The flea and tick products, especially the Advanced Care Drops are POISON.</p>
<p>
The $5.00 that I spent at Wal-Mart from your product, turned into over a $505 vet bill.  By the Grace of God, an excellent vet, and quick thinking, my two cats are on the recovery.</p>
<p>
Since this incident, I have been on the web and my eyes are now open to what has been an on going problem with Hartz products poisoning animals.</p>
<p>
In my conversation with your Consumer Relations Department, Darlene, on Friday, October 8, 2004,  she advised me to write a letter to you, send the vet bills, and get the vet&#8217;s report on and the cats.  She also advised me to contact the EPA.</p>
<p>
In my research on this, I found that the EPA has already been involved, and &#8220;through an agreement with Hartz&#8221;,  all you were required to do is repackage the poison.  It does not take a rocket scientist to SEE what is REALLY going on.</p>
<p>
Thus, I will not waste my time or energy sending vet bills, etc. due to this statement from another one of Hartz&#8217;s victims:</p>
<p>
After sending notices to Hartz&#8217;s company for over six months, she finally got a reply from them. They are wanting to send me a check for 296.00 for expenses which don&#8217;t even touch the vet bills I have had to pay if I sign a release form on their product. Class action suit against Hartz :</p>
<p>
So, here is my letter, BUT, I am not sending you bills, because I will not release you from this product.</p>
<p>
What I have done, is:</p>
<p>
Contacted  our local ABC, CBS, NBC, and FOX, our local newspaper, and most importantly:</p>
<p>
I have gone to several of our local Wal-Mart stores and have spoken with the managers in authority and have shared what has happened.  They are appalled!</p>
<p>
The process has begun for all of Wal-Mart to pull Hartz products off their shelves.  One of the manager&#8217;s wife works at the local Target, and the process of removing Hartz&#8217;s products will begin their too.</p>
<p>
I am also contacting PetsMart and PetCo and inform them of Hartz&#8217;s poisoning animals, and will seek their cooperation in pulling all Hartz&#8217;s products from their shelves as well.</p>
<p>
I have also contacted via e-mail all victims that have reported Hartz poisoning their animals and have shared what we are doing here.  And have advised them to do the same in their cities.</p>
<p>
My daughter is in the Birmingham, AL area, and she is going to do the same thing.  She stated:  &#8220;I will never buy another Hartz product.&#8221;</p>
<p>
Alabama Poison Control has called me twice to see how my two cats are doing.  I have relayed the information that I have learned regarding Hartz poison, and she is also looking into what they can do.  The Alabama Poison Control also has this report of what happened to my son regarding  inhaling the fumes off the cat&#8217;s fur:</p>
<p>
This is what happened to my 19 year old son:  He was helping me with the cats, in the middle of the night, on Wednesday night,  after midnight.  He worked for several hours with both cats, trying to wash off the the product.  He had inhaled your product for about two hours.  He told me that he had gotten a severe headache from the fumes coming off the cat&#8217;s fur, and he needed to go to bed because of how sick he felt.  He went to bed around 5:00 a.m., Thursday, October 7, 2004.<br />
He told me, just last night, Saturday, October 9, 2004 this:  &#8220;Mom, I had a really severe headache from the fumes, which you already know.  But, I didn&#8217;t tell you what happened later.  In the morning, (October 7, 2004) Thursday, I felt horrible.  I felt as if I had the flu, as my muscles were aching.  Then on Thursday night, my muscles began to tremor, just like the cat&#8217;s muscles were doing and I could not get to sleep until around 6:00 a.m.&#8221;  He stated, that he was all right now.  I asked him why he didn&#8217;t share this earlier.  He said:  &#8220;I didn&#8217;t want to worry you.&#8221;</p>
<p>
People, companies, think that they can &#8220;get away&#8221; with almost anything as long as the $$$price is right.  NOT SO WITH US!!!!!!!!!!!<br />
Truly what Hartz has sown, they will reap 100 fold.  You cast your bread on the water, and after many days it will return to you.</p>
<p>
You remind me of what has happened to Martha Stewart.  By trying to save a couple of bucks, she has lost millions, upon millions, not including herself and her reputation.</p>
<p>
Truly, in the future, Hartz will be known as:  &#8220;HARTZ, THE COMPANY THAT YOU CAN NOT TRUST&#8221;</p>

what you are doing is awesome-I just wish I would have found this site a little<br />
sooner, unfortunatly My 2 yr old Baby boy is sick and had 2 seiszures 6-04-04<br />
because of the advanced Hartz flea drops, after rushing to the emergency vet and<br />
being sent home knowing what caused it but no good solutions, I have taken him<br />
to his regular Vet Hospital and he is being treated for poisoning and being<br />
observed over night..Please everyone Pray Hartz does not make yet another Victim<br />
out of me or our precious baby boy.</p>

<p>Message: I have a strange problem with my black and white cat, he is fixed and is<br />
between 3 and 4 years old.  He all of a sudden has started pawing and humping the<br />
couch or afghan and gets all glassy eyed and makes a weird meow, I also notice that<br />
he has started growling and hissing at my boyfriend, he is playing not doing it in an<br />
aggressive way, but I am at a loss.  A friend said he could be a reaction from the<br />
Advantage that I just started giving him, but I gave it to him last year with no<br />
problem.  Can you please give me some insight into why he is doing this, I don&#8217;t<br />
really have the money to take him to a vet, oh also, he is an indoor cat.  Thanks<br />
for any help.&nbsp;</p>

This weekend was the most horrible weekend I have ever spent with my 2 pups. On Thursday night, my 2 babies started getting sick. Fifi started to bleed from her rectum. We took her to the vet and the vet thought it might be some sort of bacteria. She gave us meds and sent us on our way.</p>
<p>By Friday evening, Bubby was bleeding from his rectum as well. Both dogs had diarrhea and were bleeding very badly. They wouldn&#8217;t move or walk or lift their head. They stopped eating and drinking. We took the dogs back to the vet to get them checked out further. They were hydrated and given even more medication. My vet was great! We were so worried and concerned and tired from lack of sleep that we could barely even think straight. We thought our pups were going to die!</p>
<p>The vet thought that they might have eaten something bad, but we NEVER change their dog food and make certain there is nothing around they could get. She suggested we go home and check the expiration date of the dog food. Something we never thought to ever check!!!! We buy Eukanuba lamb &amp; rice formula from Petco. We go there because we use our pals card to get free dog food. We took our very sick pups home and checked the bag.</p>
<p>THE BAG HAD EXPIRED 1/25/2000!!!!!!! 4 YEARS OLD!!!! I was hurt and in shock! I called my vet who was certain this was the culprit of our problems! I went back to Petco to do a little investigative work. There were all types of food and treats expired!!!! I couldn&#8217;t believe that such a huge company would endanger the lives of peoples helpless pets!!!!!!</p>
<p>PLEASE PLEASE PLEASE, CHECK YOUR DOGS FOOD FOR AN EXPIRATION DATE! Not only dogs but cats as well!!! I found canned cat food outdated by 2 years! The expiration date will be on the bag either at the top, bottom, side or on the bar code. Canned food expiration dates can be found on the underside the can. If you have food, check it now!!!! If you cannot read a date or are unsure about it call the 1-800 number for questions or comments!!!! They can confirm the exp. date.</p>
<p>I will never shop at Petco again! ESPECIALLY the Petco in Pearland, Texas. I have a called placed to the District Manager, Monday I will call the main office. Our $300+ bill far exceeds the money we saved on &#8220;free bags&#8221; from Petco. My vet is willing to make a statement as well, citing my dogs problems stemmed from the food. Fifi and Bubby are recovering but not the same. The doctor has mentioned that the food may have threatened their kidneys and would like to do extensive blood work on them. Please send this to any one and everyone you know!!!!!!!
